A man was arrested today for allegedly selling “generic Viagra in the street”.
David S. Batey, 45, of Hacienda, Florida, pleaded guilty to a charge of illegally distributing misbranded and unapproved medicines, in violation of Title 18, Section 505 of the Food, Drug, and Cosmetic Act, as amended.
The case was transferred to the U. S. Attorney’s Office for the Eastern District of Florida, where it is pending, and the case was heard in U. District Court in Orlando.
Batey has pleaded not guilty to the charge.
The investigation started in 2009, when he and several other individuals, including his co-conspirators, contacted Batey’s personal physician, Dr. John B. Batey, and learned that he had a history of heart disease.
“He told me that he had a history of heart disease and that his heart condition was causing him problems,” Batey said. “He was diagnosed in May of this year, and in August he was prescribed generic Viagra for erectile dysfunction.”
Batey also said he had “an extreme amount of stress” while prescribing the medication. “He had a lot of stress at the time, and he was also very sick with pneumonia,” Batey said.
Batey was arrested today for allegedly selling “generic Viagra in the street”.
Batey has been ordered to surrender and face a preliminary hearing on the charges.
“As part of our investigation into this case, we are going to have a hearing scheduled and will be examining what the circumstances are,” Batey’s attorney, David W. Boushey, said. “We’ll also be filing a motion to suppress.”
The charges in the case have not been set for trial. Batey’s attorney said the case has already been dismissed.
“This is not the first time this man has been charged, and that is a very important case. We’re going to try to keep it as open and fair as possible,” Batey said.
The case is being investigated by U. Attorney Richard M. Young of the Eastern District of Florida.
This case is being prosecuted by Assistant U. Attorney Samuel B. McVie of the Miami-Dade County District Attorney’s Office. Assistant U. Attorney David R. Boushey, Assistant Chief Deputy Attorney General Richard M. Young and Assistant United States Attorney Benjamin K. Rosenblatt are prosecuting the case.
This case was previously prosecuted by Assistant U. Attorney William G. Stamm of the District of Connecticut.

HONG KONG – A former Hong Kong resident has been sentenced by the Probation and Rehearsal Committee (PRC) to pay $5,000 fine for the improper use of prescription drugs by the Department of Health (DH).

H. M. Keng, who was employed at the time as a registered pharmacist, was sentenced to two years in prison after he pleaded guilty to charges of illegally dispensing and misusing prescription drugs.
During a hearing in the High Court in the United States, he was found guilty on 27 occasions and also received a fine of $5,000. This fine was imposed after he was found guilty in court and sentenced to two years in prison.
The DH has been ordered to pay up to $1,500 per prescription for the drugs which are the subject of the investigation by the PRC. These include prescription drugs including Viagra, Levitra and Cialis, as well as other prescription drugs such as Xanax.
